Terms and Conditions

READ CAREFULLY: BY RECEIVING SERVICES FROM SMARTPHONE DETAILING LLC, THE CUSTOMER EXPLICITLY REPRESENTS, WARRANTS, AND ASSURES THAT THEY ARE AT LEAST 18 YEARS OF AGE AND HAVE THE LEGAL CAPACITY TO ENTER INTO THIS AGREEMENT; AND THAT THEY ARE THE RIGHTFUL LEGAL OWNER OF THE DEVICE, OR HAVE BEEN GRANTED EXPLICIT, AUTHORIZED PERMISSION BY THE LEGAL OWNER TO SUBMIT IT.

THE CUSTOMER FURTHER EXPLICITLY ASSURES THAT THE DEVICE IS NOT STOLEN PROPERTY, IS NOT SUBJECT TO ANY LIENS OR LEGAL DISPUTES, AND IS NOT BEING USED, HAS NOT BEEN USED, AND WILL NOT BE USED TO FURTHER ANY ILLEGAL ACTIVITY.

1. Scope of Services & Pre-Service Diagnostic Consultation

  • Services Provided: The Company provides professional mobile, on-site electronic device deep-cleaning, sanitization, and aesthetic detailing services.
  • Mandatory Diagnostic Consultation: To protect both parties, every service begins with a mandatory, comprehensive pre-service diagnostic inspection. Together, the technician and the Customer will complete a quick hardware checklist to evaluate the current physical health, screen responsiveness, camera clarity, port connection, and button functions of the device under magnification before we begin.
  • Baseline Documentation: Any known or discovered issues will be documented prior to the start of the deep-clean. The Customer acknowledges that not all pre-existing defects may be identifiable during this inspection, and the failure to document a particular condition does not constitute a representation that no such condition exists. Proceeding with service constitutes complete acceptance of the documented pre-service condition.

2. Pre-Existing Damage & Hardware Degradation Disclaimers

  • Invisible Defects: The Customer acknowledges that electronic devices accumulate deep oils, debris, and dirt that can mask underlying physical flaws. Prior to any deep-cleaning detailing service, it is common for devices to already have pre-existing damage and/or wear and tear, such as scratches, dents, scuff marks, cracked screens, loose buttons, missing buttons, bent connections, electrical issues, battery issues, and/or any and all existing defects which were not caused by or did not originate from the original manufacturer or factory.
  • Cosmetic Flaws Revealed by Cleaning: Deep cleaning removes built-up grime, which may cause these pre-existing imperfections, scratches, or cosmetic defects to become more visible once oils and dirt are removed and sanitized. This is a natural result of the cleaning process and is not damage caused by Smartphone Detailing LLC. SMARTPHONE DETAILING LLC IS NOT RESPONSIBLE FOR ANY AND ALL PRE-EXISTING DAMAGE, WEAR AND TEAR, AND/OR DEFECTS DISCOVERED DURING OR AFTER THE SERVICE.
  • Hardware and Battery Degradation: Devices with aged or heavily used hardware (such as lithium-ion batteries that are swollen, chemically degraded, or prone to rapid discharge) can fail due to normal handling. THE CUSTOMER AGREES THAT SMARTPHONE DETAILING LLC IS NOT LIABLE FOR SPONTANEOUS HARDWARE OR BATTERY FAILURE, INTERNAL LIQUID DAMAGE PREVIOUSLY SUSTAINED BY THE DEVICE, HARDWARE FAILURE EXACERBATED BY PRE-EXISTING COMPROMISED SEALS OR ENCLOSURES, OR OPERATIONAL ERRORS THAT ARISE FROM A DEVICE'S PRE-EXISTING INTERNAL CONDITION.

3. Data Backup Responsibility & Data Loss Waiver

  • Customer Backup Responsibility: PRIOR TO HANDING OVER ANY DEVICE (INCLUDING BUT NOT LIMITED TO SMARTPHONES, TABLETS, LAPTOPS, AND SMARTWATCHES) FOR DETAILING SERVICES, IT IS THE SOLE RESPONSIBILITY OF THE CLIENT TO BACK UP ALL DATA, PHOTOS, SOFTWARE, APPLICATIONS, AND FILES.
  • Data Loss Waiver: SMARTPHONE DETAILING LLC IS NOT RESPONSIBLE UNDER ANY CIRCUMSTANCES FOR THE LOSS, CORRUPTION, OR RECOVERY OF ANY DATA, SOFTWARE, OR PASSWORDS. THE CUSTOMER ACKNOWLEDGES THAT WHILE THE PHYSICAL MANIPULATION REQUIRED DURING A COSMETIC CLEAN POSES MINIMAL RISK TO DATA, THE COMPANY CANNOT GUARANTEE THAT DATA LOSS WILL NOT OCCUR, AND HARDWARE FAILURE CAN OCCUR INDEPENDENTLY AT ANY TIME; THEREFORE, THE CUSTOMER EXPLICITLY WAIVES ALL CLAIMS FOR DATA LOSS.

4. Advanced Booking Windows, Cancellations, & No-Show Policies

  • Advanced Booking Windows: To ensure reliable mobile routing and preparation, all appointments must be booked at least 12 hours in advance. Same-day booking requests cannot be accommodated. Additionally, our scheduling calendar accepts reservations up to a maximum of 60 days in advance to keep our mobile routes agile and accurate.
  • 24-Hour Notice Required: We value your time and reserve dedicated slots for every client. If you need to cancel or reschedule your mobile detailing appointment, you must provide at least 24 hours' notice prior to your scheduled time slot.
  • Late Cancellations & No-Shows: Cancellations or rescheduling requests made with less than 24 hours' notice will incur a cancellation fee equal to 50% of the total service value. This same 50% fee applies to no-shows, which includes instances where the technician arrives and cannot access the device or the client within 15 minutes of the scheduled time.

5. Monthly Maintenance Plans & Adjustments

  • Monthly Maintenance Plans: For Customers enrolled in a recurring Monthly Maintenance Plan, your credit or debit card on file will be automatically billed every month from the initial start date of your maintenance plan via Square.
  • Maintenance Plan Adjustments: Your maintenance plan can be canceled at any time prior to your next billing date to avoid being charged for the following cycle. For Customer accommodation, plans may be paused for a maximum of one (1) billing cycle (one month) per calendar year, after which automated billing will automatically resume to maintain your device's regular care schedule.

6. Payment Logistics, Card Holds, & Cashless Business Policy

  • Cashless Business Policy: Smartphone Detailing LLC operates as a strictly cashless business for the safety of our technicians and efficiency of service. Full payment is due immediately upon completion of the detailing service via electronic payment methods only. We proudly accept all major credit cards, debit cards, and contactless mobile payments (including Apple Pay, Google Pay, and Samsung Pay). Cash and checks are not accepted. If payment is not received at the time of service completion, the Customer authorizes the Company to charge the card on file for the full service amount.
  • Instant Verification & Card Hold: When booking your appointment online, you will see a summary of our terms and conditions right on the checkout screen. To securely lock in your time slot, you'll be prompted to place a credit or debit card on file and check the mandatory authorization box before completing your booking. BY COMPLETING THE BOOKING PROCESS AND CHECKING THE AUTHORIZATION BOX, THE CUSTOMER ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS IN THEIR ENTIRETY.
  • When You're Charged: Your card is not charged upfront. You only pay for your service once the meticulous detailing of your device is fully completed on-site. However, the card on file is strictly used to protect our schedule; if an appointment is violated under the terms of Section 4, the card will be automatically charged the 50% cancellation fee.
  • Non-Payment & Collection Fees: IN THE EVENT OF NON-PAYMENT OR A DECLINED PAYMENT METHOD, THE CUSTOMER SHALL BE RESPONSIBLE FOR ALL OUTSTANDING AMOUNTS. ANY AMOUNTS REMAINING UNPAID FOR MORE THAN 10 DAYS SHALL ACCRUE INTEREST AT THE RATE OF 1.5% PER MONTH (OR THE MAXIMUM RATE PERMITTED BY FLORIDA LAW), AND THE CUSTOMER SHALL BE RESPONSIBLE FOR ALL COLLECTION COSTS, INCLUDING REASONABLE ATTORNEYS' FEES.
  • Third-Party Platforms: Smartphone Detailing LLC uses third-party service providers, including Square, for booking and payment processing. These providers are subject to their own terms of service and privacy policies. Smartphone Detailing LLC is not responsible for any errors, outages, or data breaches caused by third-party platforms.

7. Mobile Working Conditions, Safe Access, & Force Majeure

  • Technician Access: Smartphone Detailing LLC operates solely as a mobile, on-site service. The Customer is responsible for providing a safe, clean, and accessible parking environment for the technician to perform the detailing service.
  • Location Rights: If the service location is deemed unsafe, inaccessible, or restricted by local property management, the technician reserves the right to request an alternative location or reschedule the appointment. In such an event, the Customer may be charged a trip fee to cover the Company's travel costs, and repeated occurrences may be treated as a no-show under Section 4.
  • Force Majeure Events: SMARTPHONE DETAILING LLC SHALL NOT BE LIABLE FOR ANY DELAY OR FAILURE TO PERFORM ITS OBLIGATIONS UNDER THIS AGREEMENT DUE TO CAUSES BEYOND ITS REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO SEVERE WEATHER, NATURAL DISASTERS, PANDEMICS, EPIDEMICS, GOVERNMENT ORDERS, VEHICLE BREAKDOWN, ROAD CLOSURES, OR OTHER ACTS OF GOD OR FORCE MAJEURE EVENTS. In such cases, the appointment will be rescheduled at no additional cost to the Customer.

8. Media Release & Imagery

  • Photo Permission: THE CUSTOMER GRANTS SMARTPHONE DETAILING LLC PERMISSION TO PHOTOGRAPH THE DEVICE BEFORE AND AFTER SERVICE FOR DOCUMENTATION AND QUALITY ASSURANCE PURPOSES. USE OF SUCH IMAGES FOR MARKETING, SOCIAL MEDIA, OR PROMOTIONAL PURPOSES SHALL NOT REQUIRE THE CUSTOMER'S PRIOR CONSENT.

9. Right to Refuse Service and Reasonable Suspicion

  • Right to Refuse: TO PROTECT OUR STAFF AND COMPLY WITH LEGAL OBLIGATIONS, SMARTPHONE DETAILING LLC RESERVES THE ABSOLUTE RIGHT TO REFUSE SERVICE ON ANY DEVICE THAT IS HEAVILY BIOHAZARDOUS (E.G., COVERED IN MOLD, BLOOD, OR HAZARDOUS BODILY FLUIDS), REASONABLY SUSPECTED TO BE COUNTERFEIT, OR REASONABLY SUSPECTED TO BE LOST OR STOLEN PROPERTY. In such cases, the Customer shall remain responsible for any applicable travel or trip fees.
  • Reasonable Suspicion Defined: "Reasonable suspicion" of lost or stolen property is strongly defined as circumstances including, but not limited to:
    • The Customer is unable or refuses to unlock the device, provide the active passcode, or demonstrate authorized access during the mandatory pre-service diagnostic inspection.
    • The device displays a remotely activated "Lost Mode," "Stolen Device," or "Please Return to Owner" emergency lock screen alert.
    • The device has an active cloud-based activation lock (e.g., iCloud or Samsung Lock) that the Customer cannot remove on-site.
    • Clear evidence of deliberate defacement, scratching, filing, or grinding of any serial number, IMEI, or permanent identifying markings (note: this does not apply to the removal of identification stickers which come from the original manufacturer).

10. Abandoned Property Policy

  • Immediate Possession: Smartphone Detailing LLC operates solely as a mobile, on-site service. The Customer is required to be available to take immediate physical possession of their device upon completion of the service.
  • Abandonment Window & Fees: IN THE UNLIKELY EVENT THAT A CUSTOMER FAILS, REFUSES, OR IS UNAVAILABLE TO RETAKE POSSESSION OF THEIR DEVICE AT THE TIME OF SERVICE, OR IF A DEVICE IS OTHERWISE LEFT IN OUR POSSESSION UNCLAIMED FOR MORE THAN 30 DAYS FOLLOWING WRITTEN NOTIFICATION SENT TO THE CUSTOMER'S LAST KNOWN CONTACT INFORMATION, THE PROPERTY SHALL BE DEEMED STRICTLY ABANDONED.
  • Storage and Disposal: The Customer shall be responsible for a storage fee of $5 per day, beginning the third day after completion. Upon abandonment, Smartphone Detailing LLC reserves the right to dispose of, recycle, or sell the device to recover outstanding service, travel, and storage costs, without any further liability or notice to the Customer. Any proceeds from a sale exceeding outstanding costs will be handled in compliance with Florida law.

11. Satisfaction Policy & 90-Day Service Warranty

  • Satisfaction Policy: If there is a concern regarding the cleanliness or cosmetic quality of the service that you received, you must notify us within 24 hours of completion so that we may make reasonable efforts to correct it. Such corrections shall be the Customer’s sole and exclusive remedy for cosmetic dissatisfaction. Because devices immediately accumulate daily dust and oils through normal use, re-cleans cannot be offered after this 24-hour window.
  • Our Service Warranty: WE STAND BY OUR WORK. EVERY SERVICE COMES WITH A 90-DAY WARRANTY. Should any operational issues arise as a direct result of your detailing service, please notify us immediately. We reserve the right to address and resolve the issue free of charge utilizing a certified local repair provider selected or approved by the Company, subject to our prior review and written approval of the repair estimate, which shall not exceed the original service fee paid. All other warranties expressed or implied are hereby disclaimed.

12. Limitation of Liability

  • LIMITATION OF LIABILITY: THE COMPANY’S TOTAL LIABILITY FOR ANY AND ALL DIRECT DAMAGES SHALL NOT EXCEED THE TOTAL SERVICE FEE ACTUALLY PAID BY THE CUSTOMER FOR THE SERVICE GIVING RISE TO THE CLAIM. IN NO EVENT SHALL SMARTPHONE DETAILING LLC BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, OR COMPENSATORY DAMAGES IN CONNECTION WITH THIS AGREEMENT, OR THE PERFORMANCE OR NON-PERFORMANCE OF OUR COMPANY'S OBLIGATIONS UNDER THIS AGREEMENT.

13. Comprehensive Indemnification Clause

  • INDEMNIFICATION CLAUSE: THE CUSTOMER EXPLICITLY AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS SMARTPHONE DETAILING LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND CONTRACTORS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, DEBTS, AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEYS' FEES AND LEGAL COSTS) ARISING FROM: (i) THE CUSTOMER’S BREACH OF ANY REPRESENTATION, WARRANTY, OR ASSURANCE MADE HEREIN REGARDING AGE, LEGAL OWNERSHIP, REASONABLE SUSPICION, OR CAPACITY, (ii) ANY THIRD-PARTY CLAIMS OR LAWSUITS RESULTING FROM SERVICES PERFORMED ON A DEVICE THAT WAS STOLEN, COMPROMISED, OR UTILIZED IN ILLEGAL ACTIVITY, AND (iii) THE CUSTOMER'S NEGLIGENCE OR WILLFUL MISCONDUCT IN CONNECTION WITH THE SERVICES.

14. Dispute Resolution & Mandatory Mediation

  • Governing Law: This Agreement is governed by the laws of the State of Florida, without regard to its choice or conflict of law principles.
  • Mandatory Mediation: IN THE EVENT OF ANY CONTROVERSY, CLAIM, OR DISPUTE ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES PROVIDED, BOTH PARTIES AGREE TO FIRST ATTEMPT TO SETTLE THE MATTER AMICABLY THROUGH DIRECT NEGOTIATION. IF THE DISPUTE CANNOT BE RESOLVED INFORMALLY, THE CUSTOMER AND SMARTPHONE DETAILING LLC EXPLICITLY AGREE THAT MANDATORY MEDIATION SHALL BE A STRICT CONDITION PRECEDENT TO FILING ANY LAWSUIT. THE MEDIATION SHALL TAKE PLACE LOCALLY, AND THE COSTS OF THE MEDIATOR SHALL BE SHARED EQUALLY BY BOTH PARTIES.
  • Legal Fees: No formal legal action may be initiated until mediation has been pursued in good faith and exhausted. The prevailing party in any mediation, arbitration, or litigation shall be entitled to recover its reasonable attorneys' fees and court costs.

15. Terms Modification & Intellectual Property

  • Right to Modify: SMARTPHONE DETAILING LLC RESERVES THE RIGHT TO MODIFY, UPDATE, OR REVISE THESE TERMS AND CONDITIONS AT ANY TIME BY POSTING THE REVISED VERSION ON ITS WEBSITE. CONTINUED USE OF OUR SERVICES AFTER SUCH CHANGES CONSTITUTES ACCEPTANCE OF THE REVISED TERMS.
  • Intellectual Property Protection: All content on this website, including text, graphics, logos, images, and software, is the property of Smartphone Detailing LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without the prior written consent of Smartphone Detailing LLC.

CLIENT ACKNOWLEDGEMENT & EXECUTION

By completing the booking process, checking the mandatory online authorization box, the Customer acknowledges and represents that they are at least 18 years of age, have the legal capacity to enter into this Agreement, have read, fully understand, and explicitly agree to all terms, disclaimers, warranties, waivers, and policies outlined in this terms and conditions document in their entirety.
